Jurisdiction overview of the EU whistleblower directives

On 18 July 2019, the CNIL adopted a reference framework relating to the processing of personal data intended for the implementation of a whistleblowing system. Following the transposition into domestic law of the European directive on the protection of whistleblowers in 2022, the CNIL deemed it necessary to update this reference framework. Consequently, on 6 April 2023, the CNIL published a new draft reference framework relating to the processing of personal data intended for the implementation of a whistleblowing system. This draft was subject to public consultation until 5 May 2023, and the CNIL should therefore soon adopt the final version of this updated reference framework.

In this context we have compared the position of the CNIL with those adopted in the other countries of the European Union in collaboration with the member firms of TELFA. Our work resulted in the report accessible via the link below.
